HireBus (“HireBus”,” we”, “our”, or “us”) respects your privacy and are committed to protecting it through our compliance with this Privacy Policy (“Policy”). Most of the Services that HireBus offers are provided to organizations (“Clients”). These organizations use our Services to administer assessments (“Assessments”) to potential employees, anyone else that Clients may instruct us to assess (“Candidates”) for their own business purposes. This Policy is aimed at informing such Clients as well as their Candidates, contractors, partners and users of our Website (collectively, “you”, “your”) as to how HireBus collects, uses, shares and otherwise processes personal information from our Clients, partners, Candidates and users through https://www.hirebus.com, https://app.hirebus.com/ (the “Website(s)”), and related websites, applications and platforms (collectively with the Website the “Service” or “Services”) Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our terms, your choice is not to use our Services. By accessing or using this Website, you agree to this Privacy Policy. This Policy may change from time to time (see CHANGES TO OUR PRIVACY POLICY). CHILDREN’S PRIVACY

The Service is general audience and intended for users 18 and older. We do not knowingly collect Personal Information from anyone younger than age 18.

CATEGORIES, USES, AND PURPOSES FOR PROCESSING PERSONAL INFORMATION

Depending on whether you are a Client or Candidate we collect several types of information from you and about your use of our Services, such as personal information when you sign up for or order our Services. (“Personal Information” or “Personal Data”) is information that identifies, whether directly or indirectly, a particular individual, such as the individual’s name, postal address, email address, and telephone number.  When you provide us with information in connection with a particular activity or otherwise sign up for or order our products and Services or provide your contact information to us, including your email address or telephone number in connection with that activity, product, or service, you agree that such action constitutes a purchase or inquiry establishing a business relationship with us. You expressly consent to receiving communications from HireBus through the information you provided to us. For Clients: 

These are the categories of information you provide to us or that is received by us on your behalf. This information allows us to fulfil our Service obligations to you.

HireBus RightSeat Strategy Session Information:  You may share personal information related to your organization, employees and staffing needs.  This is the optional information you choose to disclose during your “Book a Demo” call. To gain the insight  necessary for determining which our products or services may interest or benefit you.
Payment Information: Full name, company, address, credit/debit card information. You input this information when you purchase a subscription through our Website. To provide you with our Services.   To fulfill the contract between you and HireBus.
Non-Identifying Information: We also may collect non-identifying or non-personal information, such as zip codes, publicly available data, and inferences drawn from the above regarding your use of the Service. This information is collected automatically when you visit our Website. To improve the Services.

For Candidates: 

We collect Personal Data from Candidates for the purposes of administering an Assessment as instructed by and on behalf of Clients. The information we collect is generally categorized as follows:

You input this information via a webform when you are applying for a job posting on behalf of a Client, or otherwise interacting with our Services. To support Clients with recruiting, hiring, retaining, and developing their teams; to provide the Client with our Services; to fulfill the contract between HireBus and a Client.  
Contact Information including, but not limited to:  Full name, phone number and email address. You input this information via a webform when interacting with the Services. To conduct recruiting-related activities on behalf of a Client; to provide the Client with our Services; to fulfill the contract between HireBus and a Client.
Application Information: We collect your answers to applications that you submit through the Services. You input this information via a webform when interacting with the Services. To conduct recruiting-related activities on behalf of a Client; to provide the Client with our Services; to fulfill the contract between HireBus and a Client.
Assessment Information: We collect your answers to assessments that you submit through the Services. You input this information via a webform when interacting with the Services. To conduct recruiting-related activities on behalf of a Client; to provide the Client with our Services; to fulfill the contract between HireBus and a Client.
Non-Identifying Information:  We also may collect non-identifying or non-personal information, such as zip codes,  demographic data, age, gender, time zone, publicly available data, and general information regarding your use of the Service. This information is collected automatically when you visit our Website. To improve the Services; perform Website analytics and fraud prevention.

As you navigate through and interact with our Services, We and our third-party service providers, including analytics and third-party content providers, may automatically collect certain information from you whenever you access or interact with the Service. We may combine this automatically collected log information with other information we collect about you. We do this to improve services we offer you, analytics, and site functionality.

This information may include the content you view, the date and time that you view this content, the products you purchase, or your location information associated with your IP address. We collect information about where you saw the ads, we serve you and what ads you clicked on to measure the success of our advertising campaigns. Google Analytics

Google Analytics collects information such as how often users visit this site, what pages they visit when they do so, and what other sites they used prior to coming to this site. We use the information we get from Google Analytics only to improve our Services. Google Analytics collects only the IP address assigned to you on the date you visit this site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this site, the cookie cannot be used by anyone but Google.   • Clients: If you are a Candidate, we share your Personal Information with the Client who has requested you undertake an Assessment for the purposes described in this Privacy Policy. 
  • Service Providers and Network Partners: We employ third party companies and individuals to provide Services on our behalf (e.g., Calendly, Infusionsoft e-commerce, Stripe, GoHighLevel) to perform Service-related operations (e.g., appointment scheduling, maintenance services, web analytics, payment processing, and improvement of HireBus’s features) or to assist us in analyzing how our Service is used. These third parties may have access to your Personal Information in order to perform these tasks on our behalf.
    • All such third parties are prohibited from using your personal information except to provide these services to HireBus, and they are required to maintain the confidentiality of your information.
  • Corporate Transactions: We may sell, transfer, or otherwise share some or all of our assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets (including, in each case, as part of the due-diligence process with any potential acquiring entity) or in the event of bankruptcy.
  • Required by Law: HireBus will share information with government agencies as required by law in response to lawful requests by public authorities, including to meet national security or law enforcement requirements and, including without limitation, in connection with reporting earnings. We cooperate with government and law enforcement officials and private parties to enforce and comply with the law.
  • With your Consent: You may submit Personal Information to us through a form on the Website and consent to receive communication from us or our business affiliates and non-affiliates based on the information in the form.
HireBus does not sell, rent or lease Personal Information to third parties.

YOUR RIGHTS AND CHOICES REGARDING YOUR INFORMATION

You have several ways to exercise control over your information:
  • Account Settings: Registered HireBus users may access and update their personal information, and may update their communications preferences by accessing the applicable feature in their Account/profile settings.
  • E-Mail: You also may opt out of receiving marketing emails from us by following the opt-out instructions provided in those emails. Please note that we reserve the right to send you certain communications relating to your account or use of the Service (for example, administrative and service announcements) via email and other means and these transactional account messages may be unaffected if you opt-out from receiving marketing communications.
  • Contact Us: Subject to the Privacy Rights Section below, you may contact us to access, update or delete your personal information by contacting us at hello@hirebus.com.

Privacy Rights

Under applicable data protection laws, which may include the General Data Protection Regulation 2016/679 (“GDPR”), the Data Protection Act 2018 (“UK GDPR”), California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2023 (“CCPA”), and other applicable data protection laws (collectively, “Data Protection Laws”), HireBus is generally a “Processor” or “Service Provider” (or reasonably equivalent term under Data Protection Laws) of Candidates’ Personal Data with respect to the Services provided to our Clients. Our Client(s), or the relevant organization in the supply chain, determines the purposes and means of the processing and is generally the “Controller” or “Business” (or reasonably equivalent term under Data Protection Laws). The contract with our Client sets out our mandate to process your Personal Data in such instances. We may also act as a Controller/Business in instances where we process Clients’ business-related Transaction Information, provide Services directly to you and where we determine the purposes and means of processing your Personal Data. Depending on your jurisdiction, the following rights under Data Protection Laws may apply to you in relation to your Personal Data:
  • The right of access;
  • The right of rectification;
  • The right of erasure;
  • The right to data portability;
  • The right to restrict processing;
  • The right to object;
  • The right to withdraw consent at any time when data subject has given consent to the processing of his or her personal data for one or more specific purposes;
  • The right to lodge a complaint with a supervisory authority;
  • The right to not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her;
  • The right to Opt-Out of the Sale of Personal Information; or
  • The right to limit the use and disclosure of sensitive Personal Information.
If you are a Candidate and seek to exercise an applicable right under Data Protection Laws, we encourage you to contact the applicable Client, which is the relevant organization for whom you have taken an Assessment, directly, to exercise your rights. As the Client is the Controller/Business, HireBus, as a Processor/Service Provider, can only act on the instructions of the Client. If you are a Candidate and contact us directly, we can only forward your request to the applicable Client for further instructions on how to respond to your request. INTERNATIONAL JURISDICTIONS

Our Services are hosted and offered in the United States of America (US), and are subject to US federal, state, and local law. If you are accessing the Services from another country, please be advised that you may be transferring your personal information to us in the US, and you consent to that transfer, processing, and storage of your personal information in accordance with this Privacy Policy. You also agree to abide by the applicable laws of applicable US federal, state, and local laws concerning your use of the Services and your agreements with us. Any persons accessing our Services from any jurisdiction with laws or regulations governing the use of the Internet, including the collection, use, or disclosure of personal information, different from those of the jurisdictions mentioned above may only use the Services in a manner lawful in their jurisdiction. If your use of the Services would be unlawful in your jurisdiction, you may not use our Services.

SECURITY

We use physical, technical and organizational measures designed to protect your information against unauthorized access, theft and loss, including implementation of firewalls, I.P.-based restricted access controls and multi-factor authentication. We restrict access to your personal information to those employees who need to know that information to service your account or perform their job functions. Although we take precautions intended to help protect information that we process, no system or electronic data transmission is completely secure. Any transmission of your personal data is at your own risk and we expect that you will use appropriate security measures to protect your personal information. You are responsible for maintaining the security of your account and the information in your account. We may suspend your use of all or part of the Services without notice if we suspect or detect any breach of security. You understand and agree that we may deliver electronic notifications about breaches of security to the email address on record on your account.

DATA RETENTION

Unless you request that we delete certain information (see YOUR RIGHTS AND CHOICES REGARDING YOUR INFORMATION), We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. The criteria used to determine our retention periods include:
  • The length of time we have an ongoing relationship with you and provide services to you (for example, for as long as you have an account with us or keep using the Website);
